These Terms constitute the entire agreement between Benedek Inc., Sparkling-White.com (“Company”) and you (“Customer”). Company reserves the right to make changes to the Company sites, policies, and these Terms at any time without notice.

We assume no liability for any errors or omissions in the content of the site or that the servers that make the site available are free of viruses or other harmful content, or any losses or damages arising from the use of the content on the website. We do not warrant the use of materials on this website in terms of their correctness, accuracy, reliability or otherwise. The customer assumes the risk of all loss resulting from the use of this website.

Limitation of Liability
Under no circumstances, including, but not limited to, negligence, shall the company, its officers, directors, employees, or agents be liable for any direct or indirect, damages of any kind, including, but not limited to, loss of use, data or profit, arising out of or in connection with the use or the inability to use the materials on the website.

The Site and all of its contents are protected by copyright, trademark, and other laws of the United States, as well as international conventions and the laws of other countries. The Intellectual Property is the exclusive property of the website.

Children’s Online Privacy Protection
We do not knowingly collect information from children under the age of 13, nor do we share such information with third parties. Children under the age of 18 may use the website only with the direct agreement and or under the supervision of a parent or guardian.

Orders

1. At any time we have the right to refuse to accept orders for products or services.
2. Customers are responsible for the accuracy of the information provided that is necessary for us to process orders and ship products. Customers are responsible for missed shipments due to incorrect information provided at order entry.
3. Products or services purchased are for personal use only. Products and services cannot be resold or transferred to any 3rd party.
4. Orders are only accepted upon receipt for full payment from Customer, the credit card company, payment provider or any other payment service. Unpaid or partially paid orders will not be delivered.
5. Once placed orders cannot be cancelled. Order cancellations are handled as returns as specified below.
6. Products and services may be delivered or provided by 3rd party vendors or subcontractors. By placing an order on this site the customer will also become a customer of such 3rd party providers. Customer order related information, such as name and address; necessary to deliver the product or service will be shared with these 3rd party providers.
7. Regular sales tax (8.25%) will be applied to any orders originating from or being shipped to the state of Texas. Otherwise prices do not include any domestic or international taxes and duties that may apply in accordance with the purchase and delivery of these products and services. Customers are liable for all such additional charges.

Shipments

1. The company reserves the right to change its policies in regards to shipping and handling charges.
2. The company has the right to select any shipping methods for orders that did not include a specific shipping and handling charge. Shipment tracking may not be available for all such shipments.
3. When shipping and handling is charged the conditions of such shipments will be made available to the customer at order entry.
4. Certain products or services may be delivered directly by 3rd party vendors or subcontractors.

3-way shipping

1. For domestic shipments within the United States 3-way shipping includes and covers the cost of the original shipment of products to the customer, the cost of returning impressions or materials required to complete the order or service, and the final shipment of products to the customer.
2. International customer will receive the original shipment free of charge. Customers are responsible for the cost of returning impressions to the processing laboratory. Final shipments to the customer are free of additional charge.
3. International customers are responsible for all taxes and duties arising from any purchase or deliveries from this website.

Return policy

1. Customers may request a full refund within 30-days of the original purchase date.
2. The Customer is responsible for the cost of shipping the product back to us.
3. To request a refund the customer must request a return reference number from us prior to sending products back to us. Such reference number can be requested directly on the website or by sending us and email or by calling the main 800 number.
4. The customer must ship the received products back to the address below within 15 days of obtaining the return reference number. Products must be returned to the following address. Returns will not be accepted and honored if sent to any other address.

5. Order Cancellations will be handled as part of this return policy.

Use of Products or Services

1. The information on this website is provided for educational purposes only. The owners, employees and contributors of the Company are not medical professionals and therefore cannot provide medical advice, diagnosis, treatment or any other medical services. We strongly suggest that prior to the use of the products received customers should visit their dentist or other medical professionals for a health assessment and professional advice.
2. Products and services sold by this website are delivered and provided by a licensed dentist supervised dental laboratory (3rd party) and conform to all regulations required to provide such products and services.
3. Although no studies have found that teeth whitening is harmful to pregnant or nursing women, it is recommended to consult your doctor prior to the use of these products.
4. No patient relationship is established by purchasing any of the products from this website, or by using any of the information provided on this website. Benedek Inc. and sparkling-white.com will not be held liable for any damages resulting from the use of data, products or services sold on this website.
